O PROBLEMA DO LICENCIAMENTO DE GRANDES EMPREENDIMENTOS PRIVADOS EM FACE DO DIREITO URBANÍSTICO: ANÁLISE DE UM CASO EMBLEMÁTICO NA PERIFERIA DA REGIÃO METROPOLITANA DO RIO DE JANEIRO.

This book is dedicated to clarify ambiguous concepts from the world of creativity and innovation. One of the initial triggers for the development of the book was the perceived ambiguity of the binomials Design vs. Design Thinking and Innovation vs. Invention. Frequently, designers and innovation consultants are questioned by their clients about the relationships between these kind of concepts. Has the second emerged through the first, or vice-verse? Is one part of the other? Where are the similarities and which are (...) the differences? This conceptual incomprehension makes itself noticeable between many ambiguous concepts in the world of innovation and creativity. What is the difference between Radical and Disruptive Innovation? Or is Social Innovation the same as Social Intervention? And regarding Creativity, are Creativity and Creative Thinking the same? In this book the reader will find answers to these kinds of questions and doubts. 28 authors from 10 different countries and cultural backgrounds are questioning current definitions and perceptions, by comparing different sources and ideas, or simply by giving their personal opinions. The main objective of this work is to understand the daily practices of user management in post-reformist devices in the Brazilian mental health field. Through Foucault's genealogical work on government practices, understood as forms of conducting the behavior of others, it is possible to open a possible field for the study of the practices of psi knowledge, considering them as forms of management that act by through the free and natural acts of individuals. More specifically, our goal is to examine (...) day-to-day practices on some reformist devices such as CAPS through user files. Basically, two driving models have been found in the new devices: 1) Cases with frank intervention of production of commitments and agreements with users, seeking the entry of this to varied activities and political leadership ; 2) Cases with little response from the user, in which the forms of conduction are implemented by policies of inclusion of family members and close reference characters in the management of the patient's life. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. In this article, Laura Quintana elaborates on a conceptual distinction between violence and rage. Along with this distinction, she recognises that while rage may possess a destructive potential, it can also be politicised in emancipatory practices that confront conditions of injustice and structural violence. Her analysis centers on contemporary political movements in Latin America, which she views as collective manifestations of rage. Within these movements, the manifestation of rage is intertwined with forms of care and communal labor. Quintana characterises (...) such movements as embodying a “dignified rage” (digna rabia) that calls for an emancipatory transformation of the status quo. She contends that these practices can be understood in terms of the notion of “anti-violence,” as it has been coined by Étienne Balibar. In this she diverges from Judith Butler, since, according to Quintana’s analysis, such practices challenge the demand for non-violence that has often served to neutralise the disruptive force of such manifestations and movements. While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

This article provides a much‐needed review of the neural bases of implicit statistical learning. Batterink, Paller and Reber focus on the neural processes that underpin performance in experimental paradigms employed in implicit learning and statistical learning research. An important insight is that learning across all paradigms is supported by interactions between the declarative and nondeclarative memory systems of the brain. They conclude with a helpful discussion of future directions of research.

The present paper draws a contrast between the notions of τὸ παρ’ ἡμᾶς and τὸ ἐφ’ ἡμῖν to the effect that, according to Chrysippus, each has a different role to play and different requirements to meet, the former being especially tailored to suit the exigencies of praise and blame taken as exhortations, the latter those of desert and justice in praising and blaming as well as honoring and punishing.

I suggest here ecologies of the nascent state, posing the following general questions: what is this state and what is it to live, to fabricate modes of life, in its immanence? I believe populating this state is, by right, ‘ecological’, even if what I offer here is only a sketch or glimpse, playful as it is, of the possibility of such modes of life, of dwelling. As I develop it here, the nascent is in flight of being. It is populated (...) by lesser, minoritarian existences. If it is ‘ecological’, it is because these existences, or modes of becoming, are themselves, in their own right, ‘ecologies’, that is, modes of dwelling, of life, on the ‘other side of existence’, as Antonin Artaud put it once, in exile from Being. The power to return eternally to the nascent state is the power to live, to dwell, in the absolute forgetfulness of Being, in the interstice where philosophy supposedly ends, but where it nevertheless begins again, in oblivion itself, where being is never already the verticality of Being, its difference with beings, but always nascent, in the beginning, eternally so. Over the last decade, Corporate Social Responsibility (CSR) has been defined first as a concept whereby companies decide voluntarily to contribute to a better society and cleaner environment and, second, as a process by which companies manage their relationship␣with stakeholders (European Commission, 2001. Nowadays, CSR has become a priority issue on governments’ agendas. This has changed governments’ capacity to act and impact on social and environmental issues in their relationship with companies, but has also affected the framework in which CSR (...) public policies are designed: governments are incorporating multi-stakeholder strategies. This article analyzes the CSR public policies in European advanced democracies, and more specifically the EU-15 countries, and provides explanatory keys on how governments have understood, designed and implemented their CSR public policies. The analysis has entailed the classification of CSR public policies taking into consideration the actor to which the governments’ policies were addressed. This approach to the analysis of CSR public policies in the EU-15 countries leads us to observe coinciding lines of action among the different countries analyzed, which has enabled us to propose a ‹four ideal’ typology model for governmental action on CSR in Europe: Partnership, Business in the Community, Sustainability, and Citizenship, and Agora. The main contribution of this article is to propose an analytical framework to analyze CSR public policies, which provide a perspective on the relationships between governments, businesses, and civil society stakeholders, and enable us to incorporate the analysis of CSR public policies into a broader approach focused on social governance. Deep brain stimulation is a well-accepted treatment for movement disorders and is currently explored as a treatment option for various neurological and psychiatric disorders. Several case studies suggest that DBS may, in some patients, influence mental states critical to personality to such an extent that it affects an individual’s personal identity, i.e. the experience of psychological continuity, of persisting through time as the same person. Without questioning the usefulness of DBS as a treatment option for various serious and treatment refractory (...) conditions, the potential of disruptions of psychological continuity raises a number of ethical and legal questions. An important question is that of legal responsibility if DBS induced changes in a patient’s personality result in damage caused by undesirable or even deviant behavior. Disruptions in psychological continuity can in some cases also have an effect on an individual’s mental competence. This capacity is necessary in order to obtain informed consent to start, continue or stop treatment, and it is therefore not only important from an ethical point of view but also has legal consequences. Taking the existing literature and the Dutch legal system as a starting point, the present paper discusses the implications of DBS induced disruptions in psychological continuity for a patient’s responsibility for action and competence of decision and raises a number of questions that need further research. Palace of the End is a dense triptych of monologues exploring alternative narratives - albeit based in real facts - behind the events and the headlines surrounding the war in Iraq. Borrowing its title from the former royal palace where Saddam Hussein’s torture chamber was located, Thompson’s docudrama is structured as a chain of monologues telling three real-life stories set in the context of the war in Iraq. The play conveys three unconventional interpretations of the realities of war: that of (...) a young American soldier convicted for her misconduct at Abu Ghraib, the prison that stands as one of the most controversial symbols of the American-led Iraq invasion; a British scientist and weapons inspector who denounces what he understands as the false arguments given by his country’s leaders for engaging in a distant war; and an Iraqi mother whose life was shattered firstly by Saddam Hussein’s authoritarian regime, and later by the American first Gulf War. Each story is an enthralling and gut-wrenching reflection of one of the contemporary world’s most studied and controversial conflicts. The play gives voice to three different kinds of war victims, insofar as their political subjectivities and their moral conundrums are concerned. (shrink)

This book examines the significantly similar, yet finally different, thinking of two nineteenth-century existentialist thinkers, Soren Kierkegaard and Friedrich Nietzsche. Its focus is on the different ways each envisioned a joyful acceptance of life - a concern they shared. Each strove to give a place to this acceptance in his picture of life, but their conceptions of it are far apart.

This paper examines faculty perceptions regarding ethical behavior among colleagues and students, and faculty practices with regard to teaching ethics in three institutions over a 4-year period. Faculty reported an uneven pattern of unethical behavior among colleagues over the period. A majority of business courses included ethics, however as both a specific topic on the syllabus and within course discussions. The percentage of courses with ethics discussions increased in 2006, however, the time allocated to these discussions decreased. These results suggest (...) that faculty are approaching ethics instruction less formally, raising concerns over the success of curriculum integration. (shrink)

Data documenting poor understanding among research participants and real-time efforts to assess comprehension in large-scale studies are focusing new attention on informed consent comprehension. Within the context of biobanking consent, we previously convened a multidisciplinary panel to reach consensus about what information must be understood for a prospective participant’s consent to be considered valid. Subsequently, we presented them with data from another study showing that many U.S. adults would fail to comprehend the information the panel had deemed essential. When asked (...) to evaluate the importance of the information again, panelists’ opinions shifted dramatically in the direction of requiring that less information be understood. Follow-up interviews indicated significant uncertainty about defining a threshold of understanding and what should happen when prospective participants are unable to grasp key information. In this article I present a disagreement between classical and constructive approaches to predicativity regarding the predicative status of so-called generalised inductive definitions. I begin by offering some motivation for an enquiry in the predicative foundations of constructive mathematics, by looking at contemporary work at the intersection between mathematics and computer science. I then review the background notions and spell out the above-mentioned disagreement between classical and constructive approaches to predicativity. Although the view that sees proper names as referential singular terms is widely considered orthodoxy, there is a growing popularity to the view that proper names are predicates. This is partly because the orthodoxy faces two anomalies that Predicativism can solve: on the one hand, proper names can have multiple bearers. But multiple bearerhood is a problem to the idea that proper names have just one individual as referent. On the other hand, as Burge noted, proper names can have predicative (...) uses. But the view that proper names are singular terms arguably does not have the resources to deal with Burge’s cases. In this paper I argue that the Predicate View of proper names is mistaken. I first argue against the syntactic evidence used to support the view and against the predicativist’s methodology of inferring a semantic account for proper names based on incomplete syntactic data. I also show that Predicativism can neither explain the behaviour of proper names in full generality, nor claim the fundamentality of predicative names. In developing my own view, however, I accept the insight that proper names in some sense express generality. Hence I propose that proper names—albeit fundamentally singular referential terms—express generality in two senses. First, by being used as predicates, since then they are true of many individuals; and second, by being referentially related to many individuals. I respond to the problem of multiple bearerhood by proposing that proper names are polyreferential, and also explain the behaviour of proper names in light of the wider phenomenon I called category change, and show how Polyreferentialism can account for all uses of proper names. Much is being made of local food. It is at once a social movement, a diet, and an economic strategy—a popular solution—to a global food system in great distress. Yet, despite its popularity or perhaps because of it, local food (especially in the US) is also something of a chimera if not a tool of the status quo. This paper reflects on and contrasts aspects of current local food rhetoric with Dalhberg’s notion of a regenerative food system. It identifies three (...) problematic emphases—the locavore emphasis, the Wal-Mart emphasis, and the Pollan emphasis—and argues that they are shifting local food (as a concept and a social movement) away from the deeper concerns of equity, citizenship, place-building, and sustainability. It is suggested that local food activists and advocates might consider the use of multiple methodologies and forms of expression to explore the integration and reintegration of local food into diverse and redundant place-based practice. A short case study of a low-income, urban neighborhood in Lansing, Michigan, illustrates the value of contextual analysis for more fully enabling the local food movement and a regenerative food system. The aim of this article is to contribute to understanding the changing role of government in promoting corporate social responsibility (CSR). Over the last decade, governments have joined other stakeholders in assuming a relevant role as drivers of CSR, working together with intergovernmental organizations and recognizing that public policies are key in encouraging a greater sense of CSR. This paper focuses on the analysis of the new strategies adopted by governments in order to promote, and encourage businesses to adopt, CSR (...) values and strategies. The research is based on the analysis of an explanatory framework, related to the development of a relational analytical framework, which tries to analyze the vision, values, strategies and roles adopted by governments, and the integration of new partnerships that governments establish in the CSR area with the private sector and social organizations. The research compares CSR initiatives and public policies in three European countries: Italy, Norway and the United Kingdom, and focuses on governmental drivers and responses. The preliminary results demonstrate that governments are incorporating a common statement and discourse on CSR, working in partnership with the private and social sectors. For governments, CSR implies the need to manage a complex set of relationships in order to develop a win–win situation between business and social organizations. However, the research also focuses on the differences between the three governments when applying CSR public policies. These divergences are based on the previous cultural and political framework, such as the welfare state typology, the organizational structures and the business and social and cultural background in each country. The orthodox view of anger takes desires for revenge or retribution to be central to the emotion. In this paper, I develop an empirically informed challenge to the retributive view of anger. In so doing, I argue that a distinct desire is central to anger: a desire for recognition. Desires for recognition aim at the targets of anger acknowledging the wrong they have committed, as opposed to aiming for their suffering. In light of the centrality of this desire for recognition, (...) I argue that the retributive view of anger should be abandoned. I consider and dismiss two types of moves that can be made on the part of a proponent of the orthodox view in response to my argument. I propose that a pluralist view, which allows for both retribution and recognition in anger, is to be preferred. (shrink)

This book highlights some of the most pressing safety, ethical, legal and societal issues related to the diverse contexts in which robotic technologies apply. Focusing on the essential concept of well-being, it addresses topics that are fundamental not only for research, but also for industry and end-users, discussing the challenges in a wide variety of applications, including domestic robots, autonomous manufacturing, personal care robots and drones.

Camp (2009) distinguishes two varieties of conceptual recombination. One of them is full-blown or (as I prefer to call it) spontaneous recombination. The other is causal-counterfactual recombination. She suggests that while human animals recombine their concepts in a full-blown way, many non-human animals are capable of conceptual recombinability but only of the causal-counterfactual kind. In this paper, I argue that there is conceptual space to draw further sub-distinctions on how different animals may recombine their concepts. More specifically, I propose to (...) differentiate between a) narrow causal-counterfactual recombination; b) broad causal-counterfactual recombination; c) lean spontaneous recombination; d) robust spontaneous recombination. Afterwards, I focus on how these distinctions relate to several previous philosophical ideas on the representational capacities of non-human animals. I also provide several empirical examples suggesting that some animals display one or another of these four ways of recombining concepts, at least in some contexts. (shrink)

According to Weyl, “‘inexhaustibility’ is essential to the infinite”. However, he distinguishes two kinds of inexhaustible, or merely potential, domains: those that are “extensionally determinate” and those that are not. This article clarifies Weyl's distinction and explains its enduring logical and philosophical significance. The distinction sheds lights on the contemporary debate about potentialism, which in turn affords a deeper understanding of Weyl.

Over the last five decades, philosophers of language have looked into the mechanisms for doing things with words. The same attention has not been devoted to how to undo those things, once they have been done. This paper identifies and examines three strategies to make one’s speech acts undone—namely, Annulment, Retraction, and Amendment. In annulling an act, a speaker brings to light its fatal flaws. Annulment amounts to recognizing an act as null, whereas retraction and amendment amount to making it (...) null. Speakers employ retraction to cancel the deontic updates engendered by a given act. They instead use amendment to adjust its degree of strength. I will argue that annulling, retracting, and amending are second-order speech acts, whose felicity conditions vary with the type of illocution they operate on. Undoing is therefore conceived of as a form of doing. Furthermore, I claim that, in calling off our acts, we undo the conventional or illocutionary effects of our words while leaving intact their past causal or perlocutionary outcomes. (shrink)

A recurring concern within contemporary philosophy of language has been with the ways in which speakers can be illocutionarily silenced, i.e. hindered in their capacity to do things with words. Moving beyond the traditional conception of silencing as uptake failure, Mary Kate McGowan has recently claimed that silencing may also involve other forms of recognition failure. In this paper I first offer a supportive elaboration of McGowan’s claims by developing a social account of speech act performance, according to which the (...) success of an illocutionary act is not only a function of the intentions of and the conventions deployed by the speaker, but partly depends on how the act is recognized or taken up by the hearer. I then provide a comprehensive definition of illocutionary silencing and spell out what it means for it to occur in a systematic manner. (shrink)

In this paper, we introduce an enactive account of loving as participatory sense-making inspired by the “I love to you” of the feminist philosopher Luce Irigaray. Emancipating from the fusionist concept of romantic love, which understands love as unity, we conceptualise loving as an existential engagement in a dialectic of encounter, in continuous processes of becoming-in-relation. In these processes, desire acquires a certain prominence as the need to know (the other, the relation, oneself) more. We build on Irigaray’s account of (...) love to present a phenomenology of loving interactions and then our enactive account. Finally, we draw some implications for ethics. These concern language, difference, vulnerability, desire, and self-transformation. (shrink)

A prevailing view in moral psychology holds that empathy and sympathy play key roles in morality and in prosocial and altruistic actions. Recently, Jesse Prinz (2011a, 2011b) has challenged this view and has argued that empathy does not play a foundational or causal role in morality. He suggests that in fact the presence of empathetic emotions is harmful to morality. Prinz rejects all theories that connect empathy and morality as a constitutional, epistemological, developmental, motivational, or normative necessity. I consider two (...) of Prinz’s theses: the thesis that empathy is not necessary for moral development, and the thesis that empathy should be avoided as a guide for morality. Based on recent research in moral psychology, I argue that empathy plays a crucial role in development of moral agency. I also argue that empathy is desirable as a moral emotion. (shrink)
